The State of Iowa (USA) Passes Top Priority Bills and Closes 2018 Legislative Session

The 2018 Iowa legislative session adjourned Saturday, May 5th without the State House passing any bills that would either ban or regulate automated photo enforcement cameras in the State of Iowa. With the legislative session now closed and the Iowa Supreme Court ruling last week in favor of the cities of Des Moines, Muscatine and Cedar Rapids, the cities will now decide whether or not to resume their full enforcement programs.

Sensys Gatso Group, a global leader in traffic safety solutions, through its subsidiary Sensys Gatso USA, has on-going Managed Services contracts with the cities of Des Moines, Cedar Rapids and Muscatine Iowa. For the past 12 months these programs have largely been scaled back due to the Iowa Department of Transportation’s (IDOT) order to have the cities’ remove or relocate certain cameras.

Collectively, the three cities had filed an appeal challenging a district court order upholding administrative rules issued by IDOT. The appeal was ultimately successful for the cities. The conclusion was made by the Supreme Court that IDOT was without statutory authority to enforce its administrative rules regarding the cities’ automated traffic enforcement systems (ATE’s). The 2017 decision has been reversed and remanded for further proceedings consistent with this Supreme Court ruling.
